- General – The following Conditions of Entry shall apply to all ticket holders attending the Site. By attending the Site patrons agree to be bound by these Conditions of Entry. On entering the Site patrons are deemed to have accepted these Condition of Entry. On entering the Site, patrons agree to comply with all signs, instructions and directions issued by Tuff Events & Promotions Australia Pty Ltd (Tuff Events) (including its contractors or agents) and NSW Police. All instructions and directions relating to any Conditions of Entry, whether communicated by Tuff Events (including its contractors or agents) and NSW Police must be strictly adhered to at all times. This includes anything that has been considered unacceptable, unsafe or reduces the comfort or the Event experience generally for other persons. These Conditions of Entry should be read in conjunction with the ticket conditions (appearing on each ticket) and the ‘Tuff Events Patron Code of Behaviour’.
- Patron Behaviour – Patrons agree to comply with the ‘Tuff Events Patron Code of Behaviour’, a copy of which is available at www.tufftruck.com.au and upon request within the Site.
- Ticket – Patrons must not:
(a) resell or transfer, or attempt to resell or transfer, the ticket at a premium; (b) use the ticket for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services; or (c) package the ticket with other goods and services.
Patrons will be issued with a coloured wristband upon entry to the Site. Wristbands must be worn and tickets must be carried at all times and produced upon request by Tuff Events staff, Contract Security staff or NSW Police. - Refund/Exchange – Tickets will not be refunded or exchanged except in accordance with the “Code of Practice for the Ticketing of Live Entertainment in Australia” (the Code), available at www.liveperformance.com.au. Except as provided by the Code, to the extent permitted by law, Tuff Events is not liable to any person for any loss (including consequential loss) arising out of, or in connection with, the cancellation or rescheduling of the event.
- Refusal of Entry/Eviction – Tuff Events reserves the right to refuse entry to or evict any person from the event who: (a) breaches these Conditions of Entry or who Tuff Events has reasonable grounds to believe is likely to breach these Conditions of Entry; (b) jeopardises safety or security at the Site or the event; (c) is deemed to be intoxicated or disorderly or under the influence of drugs; (d) attempts to bring in, or found in possession of, Prohibited or Restricted Items; (e) engages in a Prohibited or Restricted Activity; (f) fails to comply with lawful directions by Tuff Events, NSW Police, or Contract Security staff; (g) is the subject of a previously issued with a Site ban by Tuff Events that still applies; or (h) is not authorised to be on Site e.g. without a valid entry ticket or accreditation (including patron wristband).
- Road status –The Site is a ‘Public Place’ with all roads throughout considered Roads or Road Related Areas. The Site is therefore subject to local, state and federal motor legislation. Drivers are expected to drive at walking pace and to obey any road rules at all times.
- Minors – Persons under the age of 18 years (Minors) will not be permitted to enter and remain on Site unless accompanied by a Responsible Adult.
- Responsible Adult – A Responsible Adult in relation to a Minor, means an adult who is a parent, step-parent or guardian of the Minor. A Responsible Adult cannot be intoxicated when on Site, particularly when supervising a Minor. The Responsible Adult must ensure that no alcohol is consumed by the Minor that they are supervising while in their company.
- Proof of Age – Tuff Events staff, Contract Security staff and NSW Police will randomly request proof of age for patrons who look under 25 and are drinking on Site. Patrons who fail to produce approved identity forms when requested may be evicted from Site. Identity forms that will be accepted as proof of age include a valid: (a) Australian State or Territory issued photo driver’s licence or photo drivers licence issued by another country; (b) Roads & Maritime Services (or as amended from time to time) issued proof of age card or RMS issued equivalent; or (c) a current passport issued by the Commonwealth or relevant government authority.
- Security Screening – All persons and their vehicles and possessions will be subject to searches before entering the Site and may be subject to search upon exit. Persons who refuse to participate may be denied entry or asked to leave the Site. Any person having entered the Site and found to be in possession of a Prohibited or Restricted Item, shall have such item confiscated and may be evicted from the Site and/ or handed over to NSW Police. Confiscated Prohibited or Restricted Items may be subsequently destroyed by a relevant authority.
- Surveillance – For the safety and security of patrons and staff, surveillance cameras may be operating in and around the Site. All persons entering the Site consent to having their image recorded and held for a specified period. In the event of an incident, any footage obtained may be provided to Tuff Events, NSW Police and the Contract Security Provider and used to prosecute or support the implementation of a ban on a person, or for other law enforcement purposes.
- Campsites – Patron campsites will open no earlier than 07:00hrs Friday 7th April 2017, and close no later than 19:00hrs Sunday 9th April 2017. Patrons will not be provided access outside this timeframe under any circumstance. All persons entering the Site are advised that: (a) campsites must be left in an acceptable state when departing; (b) camper vans and camper trailers are not to dump waste and sewage on the Site; (c) only small camp fires are permitted -’Small Camp Fire’ is defined as not larger than one (1) metre in diameter & no higher than one (1) metre in height; (d) all camp fires will not be located within three (3) metres of any tent, camper van/trailer, vehicle or any other structure; (e) a person responsible for a camp fire shall be present at all times; (f) any unattended fire shall be extinguished; (g) any person(s) identified placing flammable liquid / gas, fuels including but not limited to petrol, diesel, kerosene, gas/butane/aerosol cylinders, fireworks or other explosive material will be immediately removed from the Site and handed over to NSW Police; and (h) staff, contractors & competitors are not restricted to Patron times.
- Responsible Consumption of Alcohol – All persons entering the Site are advised that: (a) they are entering a non-licensed site and are expected to consume alcohol responsibly; (b) patrons identified as being intoxicated will not be permitted to enter the Site; and (c) patrons found in possession of alcohol in excess of the prescribed limit(s) will not be permitted to enter the Site or may have the excess alcohol confiscated and or be evicted from the Site;
13.1 Site Alcohol Limit
(a) the prescribed limit of alcohol that each patron over 18 years old who is camping on Site is permitted to bring onto the Site is either: i. a maximum of 30 x 375 ml cans of beer or mixed spirits; or ii. 1 litre of spirits;
13.2 Camping Area Alcohol Consumption Restrictions
(a) patrons engaged in drinking games, irresponsible drinking practices or anti-social behaviour will be asked to cease such activities. Patrons who fail to comply with this request will be evicted from the Site;
13.3 Day Competition Courses Alcohol Consumption Restrictions
(a) patrons are only permitted to bring small eskies or similar cooling devices into Day Competition areas; and (b) patrons over 18 years who enter the Day Competition Courses area are only permitted to bring a maximum of 6 x 375ml cans of beer or ready to drink cans of spirit per person at any one time;
13.4 Mud Rats Revenge (night competition) Alcohol Consumption Restrictions
(a) patrons are only permitted to bring small eskies or similar cooling devices into Night Competition areas; (b) patrons over 18 years who enter the Night Competition Courses area are only permitted to bring a maximum of 4 x 375ml cans of beer or ready to drink cans of spirit per person at any one time; and (c) any patron: i. entering Competition Course areas that is displaying signs of intoxication will be refused entry and directed back to their camping area; ii. identified as being intoxicated and aggressive or quarrelsome will be removed from the Site; and iii. engaged in drinking games, irresponsible drinking practices or anti-social behaviour shall be removed & prevented from returning to the Competition Course area for a period of 6 hours. Patrons who fail to comply with this request shall be removed from the Site;(d) it is an offence for minors to consume alcohol on Site; (e) it is an offence to purchase alcohol for (or supply alcohol to) minors; (f) persons supplying alcohol to minors will be reported to the NSW Police; and (g) penalties and fines may apply under the relevant State’s Liquor legislation. - Prohibited Items – The following is a non-exhaustive list of items that are prohibited by law and are not permitted to enter the Site: (a) illegal substances including controlled, dangerous or illicit drugs; and (b) explosives, flares, fireworks, laser pointers, smoke bombs or weapons.
- Restricted Items – The following items are considered restricted and are not permitted to enter the Site: (a) alcoholic beverages in excess of the prescribed Site limit; (b) glass bottles, and breakable containers including wine bottles/drinking vessels, jars, or any other containers or items made of glass; (c) missiles of any description; (d) chainsaws; (e) motor bikes, quad bike or any other motorised transportation vehicle; (f) couches or lounge chairs; (g) animals and pets (other than Assistance Dogs); (h) platforms, structures or materials to be used to erect platforms or other viewing platforms; (i) timber pallets (and are not to be used for firewood); (j) non-accredited photographic equipment and recording devices for commercial purposes including audio and video equipment; (k) recreational equipment such as skateboards, rollerblades and bicycles; (l) signs, banners, flags and clothing displaying offensive, political, National, racial or unauthorised commercial material; and (m) any item determined by Tuff Events, Club or Site Management that may cause injury, public nuisance, or will obstruct the view or jeopardise the safety, comfort or experience of other patrons.
- Prohibited/Restricted Activities – The following is a non-exhaustive list of activities that are restricted or prohibited on Site and participation in such activities may result in eviction: (a) consumption of controlled, dangerous or illicit drugs; (b) inappropriate or unsafe use of a motor vehicle within the Site on or off designated roadways; (c) displaying offensive or unauthorised commercial signage; (d) throwing objects of any description; (e) quarrelsome and disorderly behaviour; (f) offensive or racist language; (g) concealing identity with a scarf, balaclava, mask or other item unless for a religious, medical or other justifiable reason; (h) storage of equipment or standing/sitting in emergency aisles or walkways; (i) unauthorised soliciting and customer surveying; (j) misuse, deface, damage, remove from the Site or tamper with or attempt to misuse, deface, damage, remove from the Site or tamper with any building, seat, chair, toilet, sink, table structure, vehicle, craft, truck, pipe, tap or fitting, conduit, electrical equipment, wiring or sign or excavate or cause to be excavated any part of the area within the Site; (k) deposit litter, except in a receptacle provided for that purpose; or (l) interfere with, obstruct or hinder Tuff Events or any Authorised Person in the exercise of their powers, functions or duties.
Additionally, persons found in possession or identified consuming controlled, dangerous or illicit substances may be detained by Contract Security staff and handed over to NSW Police for prosecution. - Liability – Viewing of the Tuff Truck Challenge and associated motor sport activities can be dangerous and may result in injury. Patrons viewing such activities do so at their own risk. Patrons bring personal items into the Site at their own risk and assume all risk of any damage or loss (including property damage, personal injury, economic and consequential loss) however it arises at the Site. Tuff Events will not be held responsible for any damage to, loss or theft of a patron’s personal property. To the extent permitted by law patrons release Tuff Events (including its contractors and agents and their directors, officers, employees, consultants, contractors, teams and drivers, agents and volunteers (Promoter Group), from any liability for any damages, loss, liability or injury they may suffer or incur relating to or arising out of your attendance at the event and within the Site however caused, including without limitation due to any negligence or other act or omission of the Promoter Group.
- Pass-Outs – Are not issued, patrons wishing to re-enter the Site must be wearing required wristband to regain entry. Persons will be subject to searches upon Site re-entry.
- Photographs and Broadcasts – Photographs taken within the Site may be used only for private non-commercial purposes. Making or distributing of broadcasts, commentary, news reports or statistics (by any means including by mobile phone or other wireless device) is prohibited.
- Image Release – Patrons grant Tuff Events the non-exclusive right to use their image and likeness in any form or medium, as part of any broadcast or recording of the match and for any other commercial purposes (including in advertising and promotional materials).
- Breach of Conditions of Entry – If Patrons breach these Conditions of Entry they may be: (a) denied access to, or evicted from, the Site; (b) banned from attending future events at the discretion of Tuff Events; (c) asked for identification by Tuff Events (including its authorised contractors, agents or employees), NSW Police, or Contract Security staff.
Information collected from or on Patrons who breach the Conditions of Entry may be shared between Tuff Events, Contract Security staff and or NSW Police. This information may be used to prosecute or support the implementation of a ban on the person, or for other law enforcement purposes, and Patrons consent to such use. All information collected will be handled in accordance with Tuff Events’ Privacy Policy, which is available at www.tufftruck.com.au. - Privacy Waiver – Patrons grant consent for their name, address, date of birth and photograph to be provided to Tuff Events, by the relevant State or Federal Police or Contract Security staff, in the event that they are evicted from or arrested within the Site and for State or Federal Police to disclose to Tuff Events the nature and result of any action or criminal proceeding initiated by NSW Police as a consequence of their eviction from or arrest within the Site.
- Privacy Notification – All persons entering the Site are advised, in accordance with applicable State and Commonwealth Privacy legislation, that the relevant State or Federal Police may provide Tuff Events with the name, address, date of birth and photograph of any person detained or arrested by NSW Police at the Site and the nature of any action or criminal proceeding initiated by NSW Police as a consequence so that Tuff Events can consider, and if deemed necessary, implement a ban on the person from attending future Tuff Events promoted events.
